Terms and Conditions for Collectic

Welcome to Collectic!
These Terms of Service ("Terms") govern your use of Collectic, an AI-powered feedback portal service available at https://collectic.com ("Service"). By accessing or using Collectic, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the Service.
1. Description of Service
Collectic is an AI-powered feedback portal that helps indie SaaS founders collect, organize, and act on user feedback. Our Service includes:
- Public feedback boards for collecting user ideas and votes
- AI-powered duplicate detection using OpenAI embeddings
- Priority scoring engine based on votes, ARR impact, and effort estimates
- Kanban board for managing feedback workflow (backlog, planned, in progress, released)
- Magic link email authentication for frictionless voting
- Workspace management with custom branding and optional custom domains
- Embeddable widgets for integration into your applications
- Automated changelog and notification features
- Optional integrations with Slack, Discord, GitHub, Linear, and payment platforms
2. Account Registration and Eligibility
2.1 To use Collectic, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
2.2 You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Subscription Plans and Pricing
3.1 Subscription Tiers
- Base Plan: $5 per month, includes AI feedback portal, duplicate detection, priority scoring, kanban board, and standard features
- Custom Domain Add-On: One-time $9 fee for custom domain support and Collectic badge removal
3.2 Payment Terms
- Subscriptions are billed monthly in advance via Stripe
- Prices are in USD unless otherwise stated
- Payment is due immediately upon subscription or renewal
- Failure to pay may result in service suspension or termination
3.3 Price Changes
We reserve the right to change pricing with 30 days' notice. Changes will not affect your current billing cycle.
4. Refund Policy
- Full refunds are available within 7 days of your initial subscription purchase
- Refunds are not available for renewals or add-on purchases after 7 days
- To request a refund, contact us at bartzalewskidev@gmail.com with "Refund Request" in the subject line
- Refunds will be processed within 5-10 business days
5. User Content and Data Ownership
5.1 Your Content
You retain all ownership rights to:
- Feedback, ideas, and content submitted to your workspace
- Workspace branding, settings, and configurations
- Comments and votes collected through your feedback boards
5.2 License to Collectic
By using the Service, you grant us a limited license to:
- Store, process, and display your content as necessary to provide the Service
- Use AI services (OpenAI) to process feedback for duplicate detection and embeddings
- Back up and secure your data
- Share data with third-party integrations you enable (Slack, Discord, etc.)
This license terminates when you delete your account or specific content.
5.3 User-Generated Feedback
Content submitted by your users (feedback submitters and voters) becomes part of your workspace data. You are responsible for complying with applicable laws regarding user content collection and usage.
6. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Submit or collect content that is defamatory, abusive, harassing, threatening, or discriminatory
- Attempt to gain unauthorized access to our systems, other users' accounts, or data
- Use the Service to spam, phish, or engage in fraudulent activities
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated systems (bots, scrapers) to access the Service without authorization
- Resell, redistribute, or sublicense the Service without our written permission
- Submit excessively large volumes of data to circumvent rate limits or abuse AI features
- Use the Service in any way that could damage, disable, or impair our infrastructure
Violation of this policy may result in immediate account suspension or termination without refund.
7. AI and Third-Party Services
7.1 AI Processing
Collectic uses OpenAI to generate embeddings and process feedback for duplicate detection. By using these features:
- You acknowledge that feedback data is sent to OpenAI for processing
- You agree to OpenAI's terms and policies regarding data usage
- You understand that AI suggestions are automated and may not always be accurate
7.2 Third-Party Integrations
If you enable integrations (Slack, Discord, GitHub, Linear, payment processors):
- You are responsible for complying with those platforms' terms of service
- We are not responsible for third-party service failures or data handling
- You may revoke integration access at any time through your workspace settings
8. Service Availability and Limitations
8.1 Uptime
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.
8.2 Service Limitations
- AI processing may be rate-limited to prevent abuse
- Storage limits may apply based on your subscription tier
- We reserve the right to impose reasonable usage limits
8.3 Modifications
We may modify, suspend, or discontinue features with reasonable notice. Significant changes will be communicated via email.
9. Intellectual Property
9.1 Collectic's IP
All rights, title, and interest in the Service, including software, design, trademarks, and branding, are owned by Collectic. You may not use our trademarks or branding without permission.
9.2 Feedback to Collectic
If you provide suggestions or feedback about the Service, we may use it without obligation or compensation to you.
10. Data Security and Backup
We implement industry-standard security measures to protect your data. However:
- You are responsible for maintaining secure backups of critical data
- We are not liable for data loss due to user error, third-party failures, or force majeure
- We recommend regularly exporting your workspace data
11. Termination
11.1 By You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No partial refunds for unused time.
11.2 By Collectic
We may suspend or terminate your account if you:
- Violate these Terms or our Acceptable Use Policy
- Fail to pay subscription fees
- Engage in fraudulent or illegal activities
- Create security risks or abuse our systems
We will provide notice when possible, but immediate termination may occur for serious violations.
11.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Your data will be retained for 30 days for potential account reactivation
- After 30 days, your data will be permanently deleted unless legally required to retain
12. Warranties and Disclaimers
12.1 Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12.2 No Guarantee of Results
We do not guarantee that:
- The Service will meet your specific requirements
- AI features will be error-free or always accurate
- Your use of the Service will achieve specific business outcomes
- The Service will be uninterrupted, secure, or free of bugs
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- COLLECTIC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
- OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE
Some jurisdictions do not allow limitation of liability, so this may not fully apply to you.
14. Indemnification
You agree to indemnify and hold Collectic harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content submitted to your workspace by you or your users
15. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, available at https://collectic.com/privacy-policy. By using the Service, you agree to our Privacy Policy.

16. Governing Law and Disputes
16.1 Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.
16.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:
1. Good-faith negotiation between the parties
2. Binding arbitration if negotiation fails (except for claims that may be brought in small claims court)
16.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.
17. Changes to Terms
We may update these Terms from time to time to reflect:
- Changes in our Service features
- Legal or regulatory requirements
- Business practices or policies
We will notify you of material changes via:
- Email to your registered address
- Prominent notice on our website or Service
Continued use of the Service after changes constitutes acceptance of the updated Terms.
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Collectic.
18.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
18.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
18.4 Assignment
You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
